Terms of use

Acceptance of terms

By using the Gdayy website, gdayy.au, or the Gdayy platform, you agree to these Terms of Use with IN4M AI PTY LTD (“we”, “us”). If you do not agree, do not use them. We may update these terms from time to time, and continued use after a change means you accept the revised terms.

Two different things: the website and the platform

Different terms apply depending on which one you are using, so we separate them below.

The website (gdayy.au)
Public information about the product, hosted overseas through Cloudflare. The only thing you can submit is your email address, to register interest.
The platform (your Gdayy account)
The paid service, hosted and processed in Australia, where your agents make and take real calls on your behalf. Access is by account, and additional obligations apply.

Use of the website

The website is provided for information. You may read it and register interest. You agree not to:

Use it in any way that breaks applicable laws or regulations
Submit false, misleading or harmful information through our forms
Interfere with the website’s operation, security or accessibility
Copy or republish our content as your own

Registering interest is not a contract for service. It tells us you want access, and we will contact you when a place is available.

Your account

You are responsible for your account, the users you invite, and what your agents do once you have configured them. Keep your credentials secure, use MFA, and tell us promptly if you think an account has been compromised. You must be authorised to act for the business you are setting Gdayy up for.

Acceptable use of the platform

Because the platform places and answers real calls, you agree not to use it to:

Make unsolicited marketing calls in breach of the Do Not Call Register Act or the Spam Act
Impersonate a real person, or clone a voice without that person’s written consent
Remove or misrepresent the AI disclosure an agent gives at the start of a call
Deceive, harass or defraud people, or give advice you are not licensed to give
Upload material you have no right to use, or resell the service as your own without an agreement with us

We may suspend an account that is causing harm, and we will tell you why.

Calls, recording and disclosure

Every agent discloses that it is an AI assistant in its opening sentence, and a caller can decline recording or ask for a person at any point. Recording and disclosure obligations differ between states and industries, and meeting the ones that apply to your business is your responsibility. Nothing here is legal advice.

Your data and your customers’ data

Your call content, documents, agent configuration and cloned voices remain yours. You grant us the licence we need to run the service for you, and to improve and train our own models. We never share your content with third-party model providers, we never use it to train anyone else’s models, and we do not share it outside the suppliers listed in our privacy policy. You can export or delete your data at any time.

Connected systems

When you connect a CRM, calendar, service desk, MCP server or API, you authorise us to check that connection and to read and write records through it for the actions your agents perform. Those systems are governed by your agreement with their provider, and if one is hosted overseas, data you tell an agent to send there will leave Australia on your instruction. We are not responsible for a third-party system being unavailable, or for what it does with data it receives.

Plans, billing and usage

Paid plans are billed monthly in advance in Australian dollars. Included calls, agents, numbers and seats are set by your plan, and usage beyond the included amount is charged at the overage rate published for that plan. We do not cut your calls off when you go over. You can cancel at any time, effective at the end of the current billing period, and we do not refund part-months. If we change prices we will give you notice before your next renewal.

Availability

We work to keep the platform available and fast, but it depends on telephony carriers, connected systems and the internet. We may run maintenance, and we will avoid business hours where we can. The website and the platform are provided without any warranty beyond what the Australian Consumer Law requires.

Agent output

Agents answer from the material you give them and follow the rules you set. They can still get something wrong. Review what you put in front of callers, use routing rules for anything that costs real money, and treat transcripts and summaries as a record rather than as legal or financial advice.

Intellectual property

The Gdayy platform, website, name and branding belong to IN4M AI PTY LTD. You get the right to use the service while your account is active. You do not get the right to copy, reverse engineer or resell it.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law. Otherwise, and to the extent the law allows, our total liability for any claim is limited to the fees you paid us in the twelve months before the claim, and we are not liable for indirect or consequential loss, including lost profits or lost business.

Suspension and termination

You can close your account whenever you like. We may suspend or close an account for unpaid invoices, or for a breach of these terms. On closure we stop taking calls for you, and your data is deleted according to the retention terms in our privacy policy. Ask for an export before you close.

Governing law

These terms are governed by the laws of Queensland, Australia, and the courts there have jurisdiction.
